The difference between the two visa types is the length of marriage required; the CR-1 visa is for spouses who have been married for less than two years, while the IR-1 is for spouses who have been married for two years or more. If the marriage of a CR-1 visa holder fails before the second anniversary of the wedding, the foreign spouse will need to leave the U.S.
