Criminal Defense

Very few people realize the legal consequences of their actions. For example not many people realize the consequence of taking two beers in one hour and trying to operate their vehicle. The person may feel quite fine and comfortable with his or her ability to drive but if the police were to stop this person the officer could cite him or her for driving under the influence.

More so, there are immigration consequences for a criminal conduct for the non U.S. Citizen beyond the penalties at the criminal justice system. Here is a brief outline of what to do if you are stopped, accused, arrested or detained.

What SHOULD YOU do if you are stopped, arrested or accused of a crime:

1. Remain Calm;
Reacting impulsively can get you into more trouble. There are legal ways to protect yourself, and to fight back and prove your innocence and sometimes get even with your accuser. However you will need some help.

2. Do not discuss the matter with anyone.
You will have ample time to speak. But that is when you fully understand your legal rights, and how what you say can affect them, your case and even your freedom that you so much want to preserve.

3. One thing the police will tell you is true.
No matter how helpful -- or harmless -- you think this statement is, "anything you say can and will be used against you in a court of law." That means just what it says -- they will find a way to use ANYTHING you tell them AGAINST you.

4. What you SHOULD say.
You should be polite, calm and respectful. Tell anyone who asks about a serious accusation against you (except your lawyer): "I invoke my right to remain silent, and my right to an attorney. I HAVE an attorney, and I respectfully decline to answer any questions until I speak with her/him. Please do not ask me any more questions. May I use a telephone to contact my attorney? Thank you."

5. Retain a Criminal defense lawyer as soon as you can.
You SHOULD discuss the situation fully with an attorney. NOTHING you say to your attorney, can be used against you in a court of law. Usually, in fact, nothing you tell your attorney can even be repeated to anyone without your consent. Don't let being accused of or charged with a serious crime ruin your life. Give me a call and legal help is on the way.
We will defend your rights against DUI/DWI, domestic violence matters, theft offenses, sex crimes and other felonies.
