Update on H-1B Visa Petition

The H-1B Visa is a program that allows companies in the United States to employ foreign workers, temporarily. The specific occupations addressed in this Visa are those that necessitate the “theoretical and practical application of a body of highly specialized knowledge and a bachelor’s degree or higher in the specific specialty, or its equivalent”, according to the USCIS. These occupations are specific to certain fields, such as science, engineering, and IT.

Recently, there was an update on the H-1B Visa petition, one that set to take place as of July 24th, 2017. The update concerns the processing of these Visas, particularly in reference to cap-except H-1B petitions. Though it was previously announced in June that the premium processing for these petitions was resumed, it has not. The update refers to the petitions that are filed by physicians, under the Conrad 30 waiver program. It also refers to those filed on behalf of government agency waivers. Unfortunately, the update revealed that premium processing was still provisionally deferred for all other H-1B petitions, until further notice.

These updates come after a long line of political, social, and economic changes following the Trump administration’s crackdown on immigration to the United States.
